Regulation for vocational training in the retail industry for the skilled professions sales assistant and retail assistant
Auf Grund des § 25 Abs. 1 in Verbindung mit Abs. 2 Satz 1 des Berufsbildungsgesetzes vom 14. August 1969 (BGBl. I S. 1112), der zuletzt durch Artikel 184 Nr. 1 der Verordnung vom 25. November 2003 (BGBl. I S. 2304) geändert worden ist, verordnet das Bundesministerium für Wirtschaft und Arbeit im Einvernehmen mit dem Bundesministerium für Bildung und Forschung:
On the basis of § 25 clause 1 in connection with clause 2 sub clause 1 of the Berufsbildungsgesetz (BBiG: Vocational Training Act) from 14 August 1969 (BGB1. I S. 1112), which was last changed through Article 184 No. 1 of the regulation from 25 November 2003 (BGB1 I S. 2304), the Federal Ministry for Economic Affairs and Employment in consultation with the Federal Ministry for Education and Research enacts:

Annexes Annex 1: Sales Assistant Certification Program
Diese Rechtsverordnung ist eine Ausbildungsordnung im Sinne des § 25 des Berufsbildungsgesetzes. Die Ausbildungsordnung und der damit abgestimmte, von der Ständigen Konferenz der Kultusminister der Länder in der Bundesrepublik Deutschland beschlossene Rahmenlehrplan für die Berufsschule werden demnächst als Beilage zum Bundesanzeiger veröffentlicht.
This statutory regulation is a regulation of vocational training in terms of § 25 BBiG (Vocational Training Act). The regulation of vocational training as well as the complementary program curriculum for vocational schools, which has been concluded by the Standing Conference of the Ministers of Education and Cultural Affairs of the states in the Federal Republic of Germany, will soon be published as a supplement of the German Federal Gazette.

Annex 2: Retail Assistant Certification Program
Die in dieser Verordnung genannten Fertigkeiten und Kenntnisse sollen so vermittelt werden, dass die Auszubildenden zur Ausübung einer qualifizierten beruflichen Tätigkeit im Sinne des § 1 Abs. 2 des Berufsbildungsgesetzes befähigt werden, die insbesondere selbstständiges Planen, Durchführen und Kontrollieren einschließt. Die in Satz 1 beschriebene Befähigung ist auch in den Prüfungen nach den §§ 10 und 11 oder den §§ 14 und 15 nachzuweisen.
The skills and knowledge that are referred to in these regulations are expected to be imparted in such a way as to enable trainees to pursue a qualified vocational occupation in terms of § 1 clause 2 BBiG (Vocational Training Act), which especially includes independent planning, execution and controlling. The competences described in sub clause 1 have to be verified in the exams according to §§ 10 und 11 or the §§ 14 and 15.
(1) Die Ausbildung gliedert sich im Ausbildungsberuf Verkäufer/Verkäuferin in
1. Pflichtqualifikationseinheiten gemäß § 8 Abs. 1 Nr. 1 bis 8 sowie
2. eine im Ausbildungsvertrag festzulegende Wahlqualifikationseinheit gemäß § 8 Abs. 2 Nr. 1 bis 4.
(1) The training for the skilled profession of a sales assistant is divided into:
1. compulsory qualification modules in accordance with § 8 clause 1 No. 1 to 8, as well as
2. an optional qualification module in accordance with § 8 clause 2 No. 1 to 4 which has to be defined in the articles of apprenticeship.
(2) Die Ausbildung gliedert sich im Ausbildungsberuf Kaufmann im Einzelhandel/Kauffrau im Einzelhandel in
1. Pflichtqualifikationseinheiten gemäß § 12 Abs. 1 Nr. 1 bis 9,
2. eine im Ausbildungsvertrag festzulegende Wahlqualifikationseinheit gemäß § 12 Abs. 2 Nr. 1 bis 4 sowie
3. drei im Ausbildungsvertrag festzulegende Wahlqualifikationseinheiten gemäß § 12 Abs. 3 Nr. 1 bis 7, wobei § 12 Abs. 1 Nr. 11 zu berücksichtigen ist.
(2) The training for the skilled profession of a retail assistant is divided into:
1. compulsory qualification modules according to § 12 clause 1 No. 1 to 9,
2. an optional qualification module in accordance with § 12 clause 2 No. 1 to 4 which has to be defined in the articles of apprenticeship.
3. three optional qualification modules in accordance with § 12 clause 3 No. 1 to 7 whereupon § 12 clause 1 No. 11 has to be taken into consideration.
Die Ausbildenden haben unter Zugrundelegung des Ausbildungsrahmenplans für die Auszubildenden einen Ausbildungsplan zu erstellen.
The training supervisors have to establish a training schedule for trainees based on the program curriculum.
Berichtsheft
Die Auszubildenden haben ein Berichtsheft in Form eines Ausbildungsnachweises zu führen. Ihnen ist Gelegenheit zu geben, das Berichtsheft während der Ausbildungszeit zu führen. Im Berichtsheft ist der der Ausbildung zugrunde liegende Warenbereich zu dokumentieren. Die Ausbildenden haben das Berichtsheft regelmäßig durchzusehen.
Report portfolio
Trainees have to keep a report portfolio in the form of training verification. They have to be given the opportunity to keep that report portfolio during the duration of the training. In the report portfolio the relevant production line has to be documented. Trainees frequently have to look through the report portfolio.
Die Berufsausbildung im Ausbildungsberuf Verkäufer/ Verkäuferin gemäß § 1 Nr. 1 kann nach den Vorschriften dieser Verordnung für das dritte Ausbildungsjahr im Ausbildungsberuf Kaufmann im Einzelhandel/Kauffrau im Einzelhandel gemäß § 1 Nr. 2 fortgesetzt werden.
The vocational training for the skilled profession of a sales assistant in accordance with § 1 No. 1 can be continued according to the regulations for the third year of training in the skilled profession of retail sales assistants in accordance with § 1 No. 2.
