Hi. I would like to ask what's the best answer for this sentence:

An ethnic Korean said he ............. until a Japanese detective he had seen insulting a Korean .......... publicly.

A) won't surrender / will apologise
B) isn't surrendering / apologised
C) hadn't surrendered / was apologised
D) was surrendering / was apologising
E) wouldn't surrender / apologized

My answer is letter E, but according to the answer key it's letter C. Why? Please help me. Thank you so much.
