How to use the word VEST?

I am using the word in situation that the restricted stock vest to the employee. My question is whether we should use active voice or passive voice for this verb.

The stocks vest to the employee

OR

The stocks are vested to the employee

Here are some sample sentences from a financial dictionary:

The Employee Retirement Income Security Act (Erisa) provides that an employee must be at least 25% vested in benefits derived from employer contributions after 5 years of covered service. By the time the employee has 15 years of covered service, vesting must have risen to 100%.

I should use the preposition in ?

It is not a common verb outside of this kind of usage, Woewoe, but I would say 'Yes'-- I hear it normally as 'vested in...'.
